Por Amar Sin Ley, 4/11/18 Chapter 27 Miercoles: Bait and Switch

Chapter 27: Bait and Switch

Moving right along on D.F. Law:
  • The next day Alejandra thanked Ricardo for bringing her home the night before. He looked at her cheek to see that the swelling had gone down. She then left his office and when alone he said to himself, “Alejandra, how much I need you!”

  • Gustavo went to see Isabel, who told him she had seen a psychologist about how to help Luis. She yelled at Gustavo that “He is not responsible for your mistakes!” and Gustavo asked how she thought she would talk to him about this. She still did not know, saying she had to get her thoughts together. Gustavo said he would pick Luis up at school and take him out to eat. Isabel said not to say anything to him yet. He told her he wouldn't in the hope that they could still work this out and she would give him a second chance. [Good luck with that one.]
  • Augustín and Lalo sat at their dining table. Augustín guided Lalo's hands over Playdoh that had been molded into standard shapes to make sure he could identify and perfect them. The doorbell rang and it was Lorenza, Augustín's wife, who had received his petition for divorce. She tried to force her way inside but he guided her outside. She was indignant that he would try to get support money out of her on the grounds that he should be the sole support of their son. She implied that he was less than a man for that. She went on about how she had spent so much time taking care of Lalo before and was entitled. She then went on about how her lawyer was better than his because of the sex video scandal. He had no idea what she was talking about. A friend of hers had seen the video online.
  • Gustavo and Isabel continued to argue again about his attempt to make up with her. She finally said that the only thing she was conceding to is that their son needed him. He finally left, no better off than when he arrived. [Are we now to regard flamenco music as a bad omen?]
  • Cinthia sat in Roberto's office explaining that her daughter had inadequate representation. Thanks to this stupid lawyer she had been sentenced to six years in prison. Roberto asked if she had a recording of the hearing. She handed it to him, explaining what happened and how bad the defense was. Roberto asked the lawyer's name and she told him. He looked very pensive.
  • Alejandra paced around her office, then sat down. Olivia entered with Rosita, who felt guilty for her injury. Alejandra told her it had been an accident. Since the threat had been made against her (Rosita) she would have to be the one to bring charges against her husband. Rosita agreed.
  • Roberto tried to reassure Cinthia that her information was sufficient and he would provide the best possible defense for Nora.
  • Gustavo took Luis for burgers and fries but he was not very receptive. He wanted the truth. Gustavo told him that he had made a big mistake and that everyone must own up to their mistakes and take responsibility. The boy wasn't able to sleep and said that his mother cried all the time and why didn't he apologise. Gustavo tried explaining that such things take time. Luis wanted his father at home, not away like the fathers of his friends. Gustavo hugged Luis and told him that although he wasn't living at the house he would always be there for him. Luis did not look convinced.
  • Alejandra tried getting some work done when Carlos barged in uninvited again, saying that he was gaslighting very worried about her. He didn't want anything to happen to her. She persisted in saying that what had happened was an accident. He then said he wanted to take care of her in all things. He then had the cojones to say he wanted her to resign from Vega and come to work at his firm. He needed her to rebuild his firm. He became insistant.
    “Are you serious?” she asked.
He said he needed her specialty and said she would be a partner. She gave him a firm No. She had earned the position at Vega on her own merit. He insisted that not only did he love her he respected her legal talent. She said she was grateful for that but still insisted that they should not work together. He moved in for the kill, trying to caress her face, and she dodged it, saying she had lots of work to do and can't do it. He asked her to reconsider and she said she would see what was possible. She did not look him in the eyes. He took her hand, saying that anytime she wanted his firm was open to her. She looked like she wished he would leave. She finally said “I want you to understand me. I am not going to work with you and I will not go everywhere with you.”
“How can I be calm when you're here and these things happen?”
    “This will not happen again.”
“How can yo be so sure? I know you. You see danger and you want to help.”
“Understand this, please. What happened was an accident.”
Carlos made a gesture of defeat. “Very well.”
“Besides, I need my space. To be honest you're doing this on the pretext of solving in a a few days everything that's happened. No.”
“You're completely right,” he said, hanging his head, then looking away from her. “I want to see you because I'm [???]” He paused for a moment. “I'm sorry, forgive me. I want to see you and just tell you that I love you.” She looked away. “Now I realize that you are [???].”
He turned away and touched his eyes. “Excuse me.” He walked out. She looked both annoyed and guilty.
  • Gustavo brought Luis home and the boy was crying. He told Isabel he had forgiven his father. Gustavo kissed him before he went to his room. Isabel immediately went on the offensive asking what this was about and Gustavo said he told Luis he had made a mistake. She jumped to the conclusion that Gustavo had told him everything. He told her that children are not fools and eventually he would hear everything. Isabel didn't waste any more time; she ordered him to leave. He asked why they had ton remain separated, but she turned away. He left.

  • The next day Olivia's cell phone rang while she was at work. Arturo called. He had been waiting for her to call him but she explained that she had a difficult case involving an abusive husband and young children who needed to be protected. He said he had the perfect solution, which was to go out and have some good food, wine, and maybe dance...and she agreed.
They agreed to meet in the same place. He said he'd have something special for her.
    They ended the call.

  • Augustín and Lalo came to Gustavo's office for their appointment. Gustavo told his client that the case was going well because they had a judge who was up to date on such things. However, Augustín said he needed to discuss a delicate matter. He asked if Gustavo was good at his work and whether he could be effective in view of his current problem. Gustavo explained that he was dedicated to his case and that his own problem is in the hands of another lawyer at his firm. This was because he wouldn't handle his own case objectively. He told Augustín he had nothing to worry about. Augustín told him that his wife's lawyer had told her about this, saying that Gustavo would not be able to present his case well under the circumstances, and that a judge would not believe him. Gustavo told him that judges care about proof, not lawyers. He asked his client to believe in him because he has the (more than usual) will to win.
  • Joel visited Ricardo in his office. He had not yet vacated the house he had foolishly deeded to his children and was waiting to be evicted. He was also holding out hope that his children would help him at the last minute. Alejandra entered in the middle of their conversation and Ricardo introduced them. She knew who Joel was and Joel told her that Ricardo spoke of her frequently.
  • Olivia told Victoria that she would be going out later with Arturo. She sang his praises like a bookish high school girl who was asked out by the class president. Victoria was pleased to see her focus on someone other than Leonardo, but told her not to get her hopes up. She advised against making one's happiness dependent on a man. Olivia told her not to worry. “With Arturo I'll be in the best hands in the world.”
  • Joel told Alejandra that she was much more beautiful than Ricardo said. A few more compliments later he told her to take good care of him.

  • Victoria told Olivia one more time not to get her hopes too high because she would rebound if things didn't go well. Olivia talked about how despite the little time she had spent with Arturo she thought she could spend the rest of her life with him. She was so sure nothing bad would happen. [How many times have we said Famous Last Words?] Victoria told her to be careful.
  • Joel took his leave of Ricardo and Alejandra.
  • Leonardo stopped by Olivia's office on his way out to ask if he could pick her up the next morning on the way to court. He was helping her with Rosita's case. This was fine because she was not going to be driving that evening because she had a date. He was happy for her as he left.
  • Alejandra explained the latest development – that she knew of – regarding Isabel's divorce. He was happy to hear this and commented on Gustavo's likely reaction. She cautioned him not to say anything to Gustavo until she hears from Isabel. Talk of couples and their past, etc., ending with Alejandra hoping only that they will be happy.
  • Later Gustavo went to see Victoria to talk about the insinuation that his court case was interfereing with his court case. Victoria was confident in him. He brought up Leticia's intent to have Isabel testify. Victoria thought as a lawyer that this was a good strategy but as a woman she didn't like it. He knew that everything was at stake... and didn't know what to do about it.
  • Señor Perez came to Alejandra's office to tell her that his ex had taken his son and disappeared. He had gone to the house and got no answer to his knock. The neighbors said they had seen them leave with everything packed up.

  • Olivia arrived at the same club to find Arturo with a red rose and a bottle of red wine waiting for them. He asked how her day was and she said it was better now that she was with him. She talked a little about Rosita's case without mentioning names and he talked about how women were to be loved, respected, etc. and how he loved how she liked to help people.
    The kiss looked fabulous.
  • Alejandra told her client about an amber alert and asked if he could remember any friends or relatives that would help his ex hide. He could not.

  • Possibly an hour or more later there was still significant PDA going on in the bar when the waiter came over to ask if they wanted anything more. Arturo looked at Olivia, who said “No” so he turned to the waiter to ask for the check. The waiter cleared the table as Arturo told Olivia he wanted to be with her. She asked if he would like to see her apartment. He took out his wallet and put some money (most likely half of what he owed) on the table. They left.
  • Señor Perez provided a photo. When Alejandra sent it she told him that he would have to file charges against his ex.
  • The criminal case team discussed Nora's case. Alan's incompetence in that case made Leonardo suspect that Alan did this deliberately to degrade the firm. Roberto was taking the case and anticipated that Alan's actions constituted malpractice. He now regarded Alan as the prime suspect in the murder of the prostitute.

  • Olivia and Arturo went to her apartment and she forgot that the 70s were long over.
They disrobed en route to the bedroom and engaged in what looked like romance-novel sex.
  • Carlos called Alejandra's cell just as she arrived home.
As he descended his own staircase of doom he apologised for pressuring her then asked if he could come over and see her.
She told him she was tired and it would be better to see each other another day. He conceded and then went on about how he thought of her every minute he was in jail and how he would be with her every night when he got out. He clearly was not paying attention to the tone of her voice up to when she wished him good night and goodbye as she went up the stairs.

  • Olivia had clearly enjoyed what had just transpired and it looked like they were going to go for seconds. She said it had been a long time since she last felt this way. He got out of bed.
“I want this night to be unforgettable,” he said.
“What do you want to do?” she asked.
“Something perfect,” he said, leaning in for another kiss.
    “What?”
He removed something from her dresser drawer.
“I'm going to play. To love you. Trust me.”
Olivia protested weakly, then not at all as he tied one of her garments around her wriwrist and then her wrist to the bedpost. He kissed the tied hand, then removed another scarf from her drawer.
“What are you doing? What kind of game is this?”
“It's a special game,” he said. “When people love each other it's a love game.” He kissed her again before tying her other wrist to the bedpost before backing up and putting his trousers on.
“And now, precious, busness is business.”
    “What are you talking about?”
“Where is the money and the valuables?”
“You're playing, aren't you?” She was still smiling.
“If you don't want to get hurt, where is the money?” he shouted in her face, like a psychopath.
Then, just as the smile faded, he hit her. She screamed for help.
“Shut up, shut up! Where is the money? Where is the money?”

And he got sex tape worries.
Oh these People and their messes.

Thank you Urban

Knowing what this series was about and that many of the actors were cast against type I had a bad vibe from the beginning about Arturo.

Now predicting that Leonardo will find Olivia tied up or unconscious when he comes to her apartment to pick her up on the way to court in the morning. She will be mortified.

Carlos may be saying he wants Alejandra in his firm for her legal skills but I'm sure this is really about isolating her from Ricardo.

I didn't recognize him so I had to look it up: Augustin is played by Ernesto Alessio and his soon-to-be-ex is Margarita Magana.

People go online for dates routinely these days. I never did it because of paranoia about a situation like this.

Somebody should give Carlos an Oscar.
That"poor me"act was an award winning
Performance. I'm so happy she told him
Unequivocally NO, she is not leaving Vega. Why would she leave a million dollar mansion and go to a shack? with rats & roaches(alan & him)?

Now I'll go to bed, nighty night patio.

First of all Fabulous title and screen pics. Nothing else could quite convey the horror of Olivia's situation.

And I loved this:
She sang his praises like a bookish high school girl who was asked out by the class president.

That sweet dream died very quickly, alas. But I suppose my favorite, just because of all the great telenovela memories is:

Carlos descended his own stairway of doom

Excellent as always UA. I actually know three very happily married couples who met on line. But the potential for grave danger always exists. In any relationship when you come to think of it.

Thanks so much for all the fine work you do for CarayCaray! And Good Morning to all the patio.

Welcome back Blue Lass. Other than Urban Anthropologist, your is my favorite moniker.
JudyB (whose moniker shows a profound lack of imagination)

yourS!

Thanks Urban. Splendid as always and fantastic screen shots

Wow! I had a bad feeling about this Arturo dude but I did not see that coming. But how gullible can Oli be inviting him to "see" her apartment and letting him tie her up like that as some kind of a "love" game!
I hope he doesn't hurt her any more than he has.

Carlos is really the master of manipulation, he just knows the right strings to pull with Ale. I hate how he always manages to leave her feeling all guilty. I'm glad though she didn't give into his crazy and selfish idea of her joining his firm.

Thanks, JudyB.

I almost never remember dreams, but I actually had a nightmare last night: I was a teen in my mother's house and the doorbell rang at an obscenely early hour of the morning. My mother's room was much closer to the front door but she insisted I answer. The exterior door led to a closet-sized "vestibule" with a locked inside door that had a large glass window leading into the hallway. I peeked and saw a strange man with a pistol. I ducked back inside and locked the door to my mother's apartment (two-family house). He didn't try to break the glass, but went outside and around to the backyard. The door to that had mullioned windows. I hid in an area that couldn't be seen through any windows and I checked my purse for my cell phone. The man broke into the house and held my brother at gunpoint, then I woke up.

Oddly, I am hooked on true crime videos on Youtube and I've seen things far more gruesome but all I can think about Olivia right now is that she will have major trust issues for a long time in addition to feeling like an idiot because this happened. I doubt she will make it to court in tonight's episode.

Yikes...so sorry this episode triggered that nightmare UA. You must feel drained this morning. Glad you woke up before anything worse happened in your dream. I often feel drawn to true crime stories as well (48 Hours) but they are a terrible reminder of the dark forces that exist in people, even the most normal seeming.

Ava: I NEVER trusted that Arturo fellow either.

Victoria was right about this guy from the get-go. Olivia likely got violently beaten or worse..... whacked.

UA: Expect more aggressiveness of violence from here on.

The advice about bondage games always starts with making sure you can trust the other person. That means not going there with someone you don't know very well. Olivia needs to read sex advice books.

What has been raped here is her trust. She had what looked like great sex with this guy who went from Jekyll to Hyde immediately after. Since Olivia is a lead character I think we can safely assume that he's only a thief and not another Ted Bundy. However, he's still a sociopath and a possible psychopath.

On another note, I've seen some true crime materials that make Catalina Creel look like Mother of the Year in comparison. Look up Theresa Knorr, but only if you have a very strong stomach.

Urban, what a delight! My day has really started off on a high note with your recap.

JudyB beat me to a few of the best lines, but let me single out, "Olivia...forgot that the 70s were long over." Didn't they look like they were doing the hustle down that long hallway?

I swear I have never seen that Sr. Perez before. I think they must have a stable of random bearded guys at Televisa. ("Oye, barba numero 674! You're on!")

Thrilled to see Margarita Magana again as Lorenza. She is one of my very favorites...and she spits venom so well.

Olivia may be incredibly naïve, but no one deserves an experience like that. Hopefully Arturo takes the valuables and leaves her alone. I shudder just thinking about Leonardo finding her the next day like that. And then imagine the embarrassment she'll feel when everyone at Vega finds out. Horrible.

Urban, thank you for another great recap and fantastic screen grabs. You must be superhuman to produce such comprehensive and detailed recaps in record times and with superb screen grabs to boot.

The ending of this episode is every woman's worst nightmare. Olivia is very naïve and romantic, but she is an attorney and should have had enough common sense not to bring someone she knows absolutely nothing about to her apartment. Viewerville noticed that Arturo revealed no actual verifiable information about himself and a reasonably intelligent lawyer like Olivia should have noticed too. I do hope this criminal is only after Olivia's money, but even if this is the case, it is a horrible and traumatic situation.

Nora's case kept bothering me deeply, so I decided to dig deeper into Mexican law and this is what I found:
Article 15 of Codigo Penal Federal is concerned with "causas de exclusión del delito" and states the following in paragraph 4 : "El delito se excluye cuando se repela una agresión real, actual o inminente, y sin derecho, en protección de bienes jurídicos propios o ajenos, siempre que exista necesidad de la defensa y racionalidad de los medios empleados y no medie provocación dolosa suficiente e inmediata por parte del agredido o de la persona a quien se defiende".

So basically it's the same situation as almost everywhere in the world: the act is not criminal when it was done to protect oneself or others from a real, actual or imminent attack. It is exactly what happened to Nora, her act was a self defense against an actual and imminent attack and contrary to what her mother says to Roberto, Alan actually used the correct concept and the writers of PASL didn't do the research they should have done.
Nowhere it says that a person has to have suffered a physical damage to be able to claim self defense, on the contrary, a person can act in self defense to prevent an attack from happening.

By the way, in June 2017, a case very similar to Nora's shook Mexico and brought to the forefront the issue of treatment of sexual abuse victims in Mexico. Itzel, a fifteen year old girl, was walking home when a man threatened her with a sharp weapon and forced her to go with him under a bridge where he raped her. After the rape, the young woman managed to seize the weapon, stabbed her rapist and escaped. The man died several days later, and for some inexplicable reason, instead of providing counselling and treatment to this poor child, some terribly incompetent prosecutor decided that he must further investigate the death of the rapist by opening a murder investigation against this child. After a national outcry, the prosecutor's office made a public declaration that it was established that the child acted in self defense and the charges against her were dropped.

Blue Lass, I died laughing at your "Oye, barba numero 674! You're on!". They do have disproportionate amount of beards in this telenovela.
Sr Perez is actually the very popular Fabian Robles(Vladimir in MEPS; Dr Felipe in STUD, the hunky Efrain in La que no podia amar and many more).

Irene

Well, they need to start taking their shirts off so we can tell them apart.

Wow. So what we really have here is a misogynistic judge and an incompetent DA's office. Or did the scriptwriters copy this part from the Columbian original? There are other things that a competent defense attorney could have done here:

-- demand an investigation to find out if the rapist had been reported by other victims
-- demand an investigation to look for other DNA evidence
-- locate witnesses

Why are there no jury trials in Mexico? No jury would have convicted that girl.

Thanks, Urban. Olivia and Arturo went to her apartment and she forgot that the 70s were long over. -- Great line. Made me think of Diane Keaton in “Looking for Mr. Goodbar.”

I had figured Arturo was a player who'd bilk Olivia out of money with his smooth words, but yikes! not this. The psycho must've done this to a string of women too humiliated to press charges. Poor Olivia. The best thing going for her is having Victoria as a friend.

Loved Carlos's place. Nice dual shots of him descending and her ascending stairs. As far as living quarters, Carlos tops Ric.

I wandered what law school Alejandra went to when she said that caveman husband hitting her was an accident and that it's up to Rosita to file a complaint about this incident.
First of all, it was clearly not an accident, it was an assault committed during another assault and it clearly has to be reported to the police by Alejandra, who has the injuries to prove it. If someone robs a bank and then hits the guard trying to disarm him, he will be charged with robbery and with assault and battery. Same thing here, Alejandra intervened to stop the assault on Rosita and got assaulted herself.
Moreover, the more charges there are against caveman, the better chances for him to be convicted and to receive a significant punishment. Assault and battery of Alejandra is a solid charge, with injuries and witnesses to boot and having this charge brought against caveman would certainly improve chances of seeing him behind bars for a longer period of time.

Irene

Powerful recap, Urban!

Sooooo many good snarky takes. And the comments are to die for but I can't read them all right now.

"He then had the cojones to say he wanted her to resign from Vega and come to work at his firm.'' and
--"'Are you serious?'” she asked. --My thoughts exactly! and then,
Carlos and... Oh Noes!!! Not ...the (gulp) tears!!!?????
Door 3 is definitely in my list of tn-fan demands this go 'round!!!

As for Oli and Dimples Descarado --She's never heard of P.I.'s and checking the net for dirt background checks? I mean, remember GUS??? She doesn't know Dimples Dude from Adam and yet she touts to be this brainy capable bidnez woman. Is all her sense just book sense with not a shred of common mixed in there somewhere?? Especially in this day and age?????

That's all he tops RIC in.

Urban,
in the case of Itzel, the case never reached the court since the prosecutor's office came to it's senses quite quickly, due to overwhelming public outrage.

Nora's case is very similar to Itzel's, except that the stabbing came before the rape and Nora is not a minor. In Itzel's case it was clearly stated by the prosecutor's office that since her physical integrity and her life were at risk, she acted in self defense.
In Nora's case it's the same- her physical integrity and her life were at risk, so she acted in self defense.

I bet you are right and they copied the case from La ley del corazon, but failed to bother to research Mexican law and to modify the scenarios to apply it correctly.

Irene

Nina, his suits are also better tailored than Ric's.

Irene

I don't think oli was thinkin with her brain. She saw a good lookin man who dressed nice, seemed educated and on her Level, made her juices start to flow to her female parts and her brain went there too. It's bad enough some men think with their little partner, women we need to be smarter than that. I wished She was as watchful as vicky. I hope He don't rape her. He did slap her. This man got some deep seeded stuf
Going on and it didn't just start a moment ago either. And why didnt she do more digging into this guy's life? He did some Digging into hers probably.
I hope theres no rape but the abuse of
Women in tns/soaps seems to be popular
I'd had rather seen her bug Leo and watch romance movies than see her like this.

It was only an accident in the sense that Tomas wanted to hit Rosita and got Alejandra instead. Alejandra may be billing this as an accident to Carlos so he would cool down about her not being safe at Vega. If that was the case it has failed. He is relentless in his mission to corral her and lock her up. What happened to Olivia is a metaphor for that.

Carlos is the kind of man that poems like this are written about. Check out the comments below.

Yes, Nina, I think when we look back on this we'll remember it as the Domestic Violence TN.

Urban--Twenty seven comments and counting. I bet I know what most of them are about. Your recap was "Picture Perfect." Now with my 2d cup of java, I'll settle down to read in-between the captions. Be back later.

Urban—In addition to the aforementioned Best Lines, here are my favorites, “Carlos barged in uninvited again, saying that he was (*gaslighting*) very worried about her.” And, “He moved in for the kill, trying to caress her face, and she dodged it..”

We all knew Arturo was bad news, but I had expected him to string Oli along a little longer to make his Jekyll/Hyde act more believable. Still Olivia thought the best of him until the very last when he hit her. If this is his M.O., he must stay very busy wooing and robbing gullible ladies. I hope Oli has enough spine left to go after him, legally, and nail him.

The scene with Joel, Ric, and Ale was the warmest, cute and satisfying one of the whole episode. I hope Joel stays around—maybe in Ric’s apartment for awhile. We need him to play cupid and bring these two back together.

Irene—Inquiring minds need clarification from a legal expert—if Nora was “duly” convicted and sentenced, isn’t an appeal the only route they can take? Why are the Vega attorneys talking about “defending” her in the case with a new strategy? Aren’t they now the appellant and appellee? Since technically, “No new evidence is admitted on appeal, for it is strictly a legal argument*,” can malpractice be entered as key factor? ("Malpractice does not include the exercise of professional judgment even when the results are detrimental to the client or patient**.")
* and ** from Law dot com

Anita--I am fascinated watching the actor playing Joel as a warm, fuzzy teddy bear. I first saw him as the most vile, sadistic, reprehensible villain in Pasión.Unpeakable. I still shudder when I think of some of his scenes. And yet he's totally believable and lovable in this one. Whew.

JudyB--Jose Elias Moreno, Jr. was equally disgusting in Amor Bravio, but redeemed in Quiero Amarte. When you try to find him, using a link provided in the cast list of his appearances, you keep getting his father (b.1910), a well known (but now deceased) actor. At least Wikipedia now has a small entry recognizing his son (b.1956), our teddy bear.

Ohmigosh, you're right Anita. He was equally loathsome in Amor Bravio! Yikes, what a marvelous chameleon.

Urban, checked further into Ernesto D'Alessio. He didn't stand out, but he was Dario (Jaime's cousin; Jaime was the one married to Julieta, in AQNMD). I think he looks quite handsome with the full beard. Gus' looks like he forgot to shave for a couple of days--the grey is not becoming.

I don't like the hipster beard. I like Carlos Ferro's beard in CET. It was flattering and neatly groomed.

Urban--I loved EVERYTHING about Carlos Ferro in CET.

I don't feel sorry for Olivia one bit. That being said, she doesn't deserved to be assaulted. But inviting a stranger into her home and getting robbed? Too bad, so sad.

Alejandra needs to put her foot down with Carlos and stop being so weak.

Gustavo was wrong for telling the child anything because that was a manipulative move to get the boy's tears to get Isabel to stay, whether Gustavo knew he was doing that or not.

The problem with Gustavo is he really doesn't know what he wants or who he really is. And until he can figure that out, he's going to continue going downhill.

I think gus knows what he wants, he forgot who he was. A year ago he got
Started wondering away from who he was
And landed on Melina. He started going
Down hill from a year ago when he just
Threw away the respectable guy he was and became the schmuck he is today. He
Enjoyed that outside marriage argasm
And didn't give a good dam about the pain he was causing his family. I feel
Sorry for little Louis. Hes suffering cuz daddy was a selfish jerk.

Anita, almost every single aspect of law and procedure is incorrectly depicted in this telenovela, including the appellate procedure.

You are totally right, new evidence is not admitted on appeal, but we are talking here about a telenovela where private parties routinely conduct criminal proceedings, where the concept of conflict of interests doesn't exist, where random lawyers can act as prosecutors whenever the plot requires it and where presumption of innocence is mentioned in one episode and completely disregarded in the following one, so it's not surprising that the writers didn't consult the Codigo Federal de Procedimientos Penales regarding appeals.

To be precise, article 363 of the abovementioned Codigo states the following :"El recurso de apelación tiene por objeto examinar si en la resolución recurrida no se aplicó la ley correspondiente o se aplicó ésta inexactamente, si se violaron los principios reguladores de la valoración de la prueba, si se alteraron los hechos o no se fundó o motivó correctamente".

So, the purpose of the appeal is to examine the sentence and to decide whether the appropriate law was applied or was applied inaccurately, whether the principles of the evaluation of the evidence were violated, whether the facts were altered or the sentence was unfounded or incorrectly motivated.
In laymen's words, the party appealing the sentence thinks that the judge made a mistake that needs to be corrected by a higher instance.

In Nora's situation, where a judge sentenced a defendant to years in prison knowing full well that said defendant is innocent and can be exonerated if a different article of the law is applied (instead of suspending the trial and appointing another, more competent defense attorney), the appeal should actually be based on the fact that incorrect law was applied by the judge, not on the fact that a defense attorney made a mistake of law.
Of course, PASL writers are wrong regarding the applicable law (Nora's action really qualifies as self-defense according to article 15 of Codigo Penal Federal and Alan made no mistake), but assuming that Alan was wrong and the judge knew it, it is the judge's decision that should be attacked, not Alan's ineptness.

I am swamped with my own caseload, so have no time to do a proper research regarding Mexican law, but this is a highly unusual situation where, in addition to inept defense attorney, both the prosecutor and the judge completely failed to do their job and I have a feeling that such an extreme miscarriage of justice maybe even warrants a retrial, not just an appeal. By the way, this prosecutor must be guilty of prosecutorial misconduct for the way he abused his prosecutorial discretion to charge Nora with murder when he knew full well that she is innocent.

Gustavo is between a rock and a hard place. He got caught. We don't know the details of what he told Luis but he is right about one thing: Children aren't fools. If Luis' classmates see anything about this on the news or over hear their parents talking about it he's going to hear about it and not in the right way. The boy put him on the spot.

What should happen here is that someone should get Isabel to testify even if it's painful. If the video isn't pulled and it goes too far, Gustavo's career goes down the toilet and he has a child to support. Isabel might come from money but she should not have to shoulder all the expense. Beyond that Gustavo doesn't deserve to get her back.

Irene--We thank you from the bottom of our hearts. We appreciate all you do to clarify our understanding of Mexico's REAL law (as foggy as Mexican law is when depicted on TV). However, you mustn't let the interpretation of their laws interfere with YOUR real work (said with tongue in cheek--'cause we really want you to keep it up).

Urban--I got the impression Gustavo tried very hard not to reveal any details to Luis. He had just had that conversation with Isa. You are correct that Luis put him on the spot and he went as far as telling him he made a mistake and it was his fault. He couldn't understand why his mamma couldn't just forgive him. That told me he didn't get into the weeds.

Anita, I suspect that this patio will have to soldier through my ramblings until the end of this telenovela. I tend to peruse the Codigo Penal Federal for fun with a cup of coffee and a muffin during breaks from work.

Irene

Just picturing you with your coffee and muffin, Irene! A gal who gets her jollies perusing the Codigo Penal Federal is pretty darn special in my book.

JudyB (more into light reading)

JudyB, I sometimes have to deal with emotionally draining and heartbreaking situations at work, so clearing my mind by spotting the differences and the similarities between legal systems during my coffee breaks is actually almost therapeutic and somewhat entertaining.

Irene

I'm glad you have found a way to clear your mind that is both informative and healthy (as opposed to drinking or overeating) Irene. I read a book once called Keeping It Civil written by a family lawyer who had to overseer heartbreaking cases of people who once loved each other now tearing each other apart in divorce court. And I'm sure you're dealing with even worse. Bless all the good lawyers and those who try to help others negotiate these dreadful phases in their lives.

And sweet lady, what are you doing up at 4 am!?

Judy B: The actor, who portrayed Rivero in Telemundo's "EL SENOR DE LOS CIELOS" is in this TN.

JudiB, I was working for several hours on something urgent, was on a roll and just kept going until it was done. I didn't even notice how late it was.
I am quite satisfied with what I came up with, so my beauty sleep wasn't sacrificed in vain. On a more negative note, I had to skip PASL, but will maybe watch it later.

Irene

Admire your dedication amiga. If I ever had legal troubles, I would want a lawyer like you, Irene.
